Supreme Court Justice AHMD Nawaz has recused himself from hearing the fundamental rights petition filed by former Governor of the Western Province, Azath Salley who has been arrested and remanded under the provisions of the Prevention of Terrorism Act.
Justice Nawaz has stated that he is recusing himself from hearing the case due to a personal reason.
The petition was taken up before a three-member bench comprising of Justices Murdu Fernando, AHMD Nawaz and S Thurairaja this morning.
Former Governor Azath Salley is seeking a declaration from the Supreme Court that his detention under the PTA as illegal.
Accordingly, the petition will be taken up before a new bench on the 27th of August.
