COLOMBO (NewsRadio); Court today declared it will not issue an order related to the arrest of State Minister Diana Gamage on offences under the Immigration and Emigration Act.
When the case was taken up today, Colombo Chief Magistrate Prasanna Alwis informed that an order for the arrest of State Minister Diana Gamage will not be issued since the Criminal Investigation Department is empowered by law to take the necessary steps over the relevant offences.
Previously, a writ petition was filed before the Court of Appeal calling for State Minister Diana Gamage to be stripped of her Parliamentary seat by activist Oshala Herath.
State Minister Gamage, the Immigration and Emigration Controller, the Minister of Public Security, the General Secretary of the Samagi Jana Balawegaya, the National Election Commission and its members, and the General Secretary of Parliament were cited as respondents in the petition.
The petitioner claimed that State Minister Diana Gamage holds British citizenship and according to the country’s Constitution, such an individual does not qualify to hold the position of a Member of Parliament.
Therefore, Oshala Herath requested the Appeal Court to declare that State Minister Gamage is ineligible to hold a Parliamentary seat and to issue a writ of annulment.
