A writ petition has been filed before the Court of Appeal seeking the annulment of the decision by education authorities to increase the number of students allowed in a classroom to government schools to 40 in violation of Supreme Court orders.
The petition was filed by the Chief Secretary of the Ceylon Teachers Union Joseph Stalin.
The Secretary to the Ministry of Education, the Director of National Schools and Minister of Education Prof. GL Peiris have been named as respondents.
The petitioners allege that in 2011 an order issued by the Supreme Court limited the maximum number of children per class in national schools to 35.
However, they charge that a circular issued by the Secretary to the Education Ministry on the 28th of May increases the limit in a classroom in a government school for Grade 1 to 40, and claim it is contrary to the Supreme Court order as well as provisions of the Education Services Act.
Accordingly, the petition seeks an order to invalidate the circular issued by the Secretary to the Education Ministry.
