Samagi Jana Balawegaya Parliamentarian Eran Wickramaratne today claimed that the Attorney Generals Department has been politicised.
Speaking in Parliament during the Committee Stage Debate of the 2022 Budget on the expenditure heads of the Ministry of Justice today, MP Wickramaratne said many cases filed by the Attorney General have been withdrawn.
Citing examples MP Wickramaratne said cases filed against Sajin Vass Gunawardena, Minister Johnston Fernando, Minister Rohitha Abeygunawardena, Minister Basil Rajapaksa, Minister Mahindananda Aluthgamage, and Minister Janaka Bandara Tennakoon were all withdrawn in the recent past.
The MP said he is not claiming that the group mentioned were guilty; yet stated that such withdrawals of cases have not been reported elsewhere in the world adding it brings disrepute on Parliament.
MP Wickramaratne said cases are filed and subsequently withdrawn, stating that legal action should not be sought if there is no evidence against the accused.
He said after cases are filed, government’s change and the Attorney General subsequently claims that there is no evidence against a suspect and withdraws the case themselves.
He called for steps to be taken to look into the Attorney Generals Department.
Responding, Minister Johnston Fernando said they never withdrew cases by influencing the government or the Attorney Generals Department.
The Minister charged the former good governance government of baselessly filing cases against the then government.
Minister Fernando called for MP Eran Wickramaratne to remain just.
He said a case against him is still being heard and said he attended a Court hearing last Friday as well.
Minister Fernando said the present government has ensured democracy at all institutions including the Police.
