The Court of Appeal today dismissed a writ application filed by a group of parents against the decision by the Attorney General to refrain from taking forward charges against former Commander of the Navy Admiral of the Fleet Wasantha Karannagoda, in relation to the youth abduction case.
The Appeals Court bench comprising Justices Sobitha Rajakaruna and Dhammika Ganepola dismissed the petition without taking up for consideration.
The Appeals Court bench is of the view that the Attorney General has the powers to decide on filing indictments on an individual and the court cannot intervene in such a decision.
A writ petition was filed by four relatives of the missing youth before the Court of Appeal challenging the decision reached by the Attorney General to refrain from taking forward charges against former Commander of the Navy Admiral of the Fleet Wasantha Karannagoda, in relation to the kidnapping and disappearance of 11 youth in Colombo.
The petitioners called for the charges against the former Navy Commander to be continued until the conclusion of the hearing of the writ petition.
